with them, camping equipment it seemed to him. i think he described the interaction as odd but nothing alarming. >> we'll go to cascade, idaho. miguel, the wilderness area is 2.3 million acres. so what are authorities doing to find them right now? >> reporter: it is a huge area and right now they've cordoned off some of the perimeter blocking it off and monitoring all traffic into and out of the forest area. they believe they've cast the net wide enough so any direction they would have gone over the two days since they've been spotted they'd still be within that area. they are also preparing hundreds of searchers to get up there in vehicles, horse back, and by helicopter in order to get into specific areas and try to figure out where they might be and look for any signs of life in this vast wilderness area. >> miguel, what do authorities make of this characterization of

this person on horse back that this was odd but there was nothing alarming suggesting that she didn't seem particularly agitated when they saw her? >> i spoke to investigators yesterday and they said that she did not appear to be under duress. the person on horse back who said that it seemed odd. it's not clear whether or not the -- their actions or behavior was odd or whether or not just them being out in the middle of nowhere was odd. i do know they had fairly light camping gear, medium to light, not the heavy, rugged stuff you'd expect to be several days into a very back wilderness area like they were. and he also didn't come to that conclusion it was odd until after he realized they were -- the people that were being searched for in the amber alert. so it is hard to draw a lot from that statement. we were trying to talk to that person on horse back to get a little more clarity on that, victor. >> very difficult week for this family. hopefully they get some answers

soon. thank you. and be sure to stay with us because later this morning we'll speak with a friend of hannah's to ask about the relationship between dimaggio and anderson and his so-called crush on her. we also have new information this morning about embattled san diego mayor bob filner who is of course mired in a sexual harassment allegation controversy. he has left we found out a behavior therapy program a week early. that is according to his chief of staff. >> recall efforts are ramping up including a letter from personal friend senator barbara boxer urging him to step down. let's start with this departure from this intense therapy. what do we know about that? just so bizarre. >> really. >> he checked in early is what his office is saying so that is why he checked out early but his critics are saying he just used this as an excuse to get out of a deposition, a sexual harassment lawsuit filed by his former communications director. he was supposed to give the

deposition august 9th while in rehab and got a note from his doctor saying he couldn't show up. his critics are saying he used this as an excuse to get out of that. he didn't want to commit perjury. his office says he'll continue in an out patient program. it is unclear whether he'll even be able to get into his office. the locks were changed on mayor filner office overnight so we're waiting to get comment from mayor filner. he has not spoken at all about this. it is unclear who ordered the locks changed or why but the city attorney office told our local affilite they agreed with the move. you talked about that personal letter, right, the barbara boxer letter. he is getting criticism from all angles including his personal friend who wrote an open letter which said in part i believe we have a graphic here on this. it says i must say this directly to you, bob. you must resign because you have betrayed the trust of the women you have victimized, the san diegan you represent, and the people you have worked with throughout your decades in public life. he is getting it from all

angles, guys. >> what made it very clear he just wants to hang on right now to power as mayor, he is nhas n appointed an interim mayor. he wants to stick it out. some people have said maybe he's trying to run out the clock. some people want to recall him. where does the effort stand? >> this is where it gets tricky. bob filner could be in office until early 2014. because of all the red tape surrounding a recall not only could it be very expensive "the washington post" says as much as $6 million to have this recall, but it takes time. this group has to collect signatures, they have to get a stamp of approval by the city clerk, then the city council has to vote on it. all of that could take months. it could be as early as november we see this recall go forward or as late as early next year. so bob filner, you may be hearing this name for a long time to come. >> is interesting they changed the locks. he hasn't resigned, no recall. someone says he shouldn't be back in. we'll see where that goes. >> that says you're not welcome here doesn't it? >> thank you. >> all right.

appreciate that. well, the rain is still causing a lot of trouble across the country. wow. those cars were just washed off the highway in manitou springs, colorado. 17 states are under a flood watch warning this morning. let's go to the cnn severe weather center. jennifer, this video is amazing. >> incredible. we are talking about flash flooding as well as a mud slide. you saw those cars just washing away. we have seen scenes like that out of the midwest as well as the plains over the last couple days but out of manitou here is the cell that moved through. it was quite strong and produced roughly 1.5 inches of rainfall. it is a burn scar area. that allowed for even greater runoff and that is from the fires from last year alone. that's the result of that. now as we look at the radar notice what's happening there. showers and thunderstorms once

again just parts of missouri as well as arkansas. the heaviest rain right now in the southeastern part of missouri. that's why we have flood warnings and watches in place through today. a lot of the flash flood warnings are going to expire around 9:00 local time but some of the watches are going to last until 1:00. that means it's still going to be dangerous out there. make sure you're paying attention to the roadways and not driving through or walking through some of the flooded streets. as i point out some of the rainfall totals, some of these picked up more than 15 inches of rainfall in five days. that's why we're talking about all this flash flooding and more is on the way. we point out for areas like southern missouri we could see another 2 to 4 especially in the southeastern portion. but anywhere in yellow is where we'll see our heaviest rain over the next couple days on a wider view out in the west if you want sunshine or dry air you need to go out in that direction and for areas including the northeast we'll see some scattered showers around. here are your high temperatures for today. 100 degrees in dallas. it is going to be hot down in

>> a general impression has i think taken hold not only among the american public but also around the world that somehow we're out there willy nilly just sucking in information on everybody and doing what we please with it. that's not the case. >> reporter: at the same time he says leaks from edward snowden have given the programs a bad rap. >> i don't think mr. snowden was a patriot. >> reporter: to give the american people more confidence he is proposing working with congress to put more safeguards on the patriot act program that collects their telephone records. an independent voice to challenge government claims when it asks a judge to approve the programs, that the intelligence community create a website detailing what it does and doesn't do, and that the justice department make public the legal basis for the programs. he wants outside experts to reveal whether there are new ways including technology to

prevent abuse. >> if i tell michelle that i did the dishes, now, granted, in the white house i don't do the dishes that much. but back in the day. and she's a little skeptical, well, i'd like her to trust me, but maybe i need to bring her back and show her the dishes. and not just have her take my word for it. >> show her the dishes. that's what he is saying. rene marsh joining us now live from washington. rene, one of the, i think, perhaps complicating factors here is congress. i mean, congress will have to get involved here. how likely is it that they'll be able to act? >> reporter: right. you're right about that. you heard the president in his own words yesterday. he said that he does plan to work with congress to reform the patriot act, which we know allows the government to collect americans' phone records, specifically the phone numbers and the duration of the call. so the goal would be to improve

privacy protection. we do know that following the president's press conference the senate intelligence committee announced already that they're planning on holding major hearings on this very issue but your question how likely is it that congress will act? we know that there are deep divides over this. lawmakers who say the program is working well as is but there are other lawmakers who say the president must do a better job at balancing national security along with privacy rights. so you know what that means when there is a divide. it means we're setting up for another fight and you know how that works here in d.c. >> that's right. it is so weird. i think a lot of people are look agate this. you have some folks on right and the left who feel similarly about these programs. they don't like them. it is going to be a very interesting fight come fall. rene marsh in washington, thanks. we have new video this morning of the 31-year-old man in florida accused of murdering his wife and then posting a photo of her dead body on facebook. look at this.

place. >> rena ode n and the woman caring for the boy also took the stand. the judge found her to be a competent care giver despite testimony from foster raymond saying she did not think aunt rena could handle the boys. >> there are times foster said while on the stand that she doesn't know where the boys are. she doesn't have a phone number for them. she doesn't know who was with those children. so obviously for a mother it is distressing. >> and having lost her other son recently, usher's step son. the judge went on to say the boy's near drowning was an awful accident and he is not certain any one person could have done a better job taking care of the boys. was it racism or a simple misunderstanding? you know we're talking about why queen of talk oprah says she didn't exactly get the royal treatment recently at a boutique in zurich. her startling allegation and a response after the break.

she was last seen with her alleged kidnapper james dimaggio in a vast wilderness area in idaho. hikers say that she appeared calm and the pair appeared to have been camping and had camping gear with them. >> number two san diego mayor bob filner is out of counseling a full week earlier than expected. filner told reporters he spent two weeks in therapy but he was there for just one. 11 women accused filner of sexual harassment. he refuses to resign, though, saying he will be vindicated. number three, this is amazing video here, this scene coming from manitou springs, colorado where heavy rain funneled flood water through a canyon sweeping cars away in two to three feet of muck there. three people were hurt and reports say that one person may be missing. >> here's number four. four former vanderbilt football players are facing aggravated rape charges this morning.

authorities in nashville say the men sexually assaulted an unconscious woman in the dorm in june. the university kicked the players off the team shortly after the incident came to light. one suspect is now in custody. the whereabouts of the other three are still unknown. >> number five, new surveillance video shows derek medina turning himself in to police. he is the south florida man who allegedly killed his wife then posted a photo of her dead body on facebook. the man behind medina is his father. the man that you will see. medina has been charged with first-degree murder. he is being held without bond. calling the search for hannah anderson and james demaggio difficult is an under statement. the pair, thought to be in a wilderness area more than 2 million acres. plenty of room to get lost in the wild. all of this started a thousand miles away with an amber alert and a deadly fire. >> just please let my daughter go. >> bret anderson desperately

wants his daughter hannah back. police believe his friend of 20 years james dimaggio snatched hannah sometime after the 16-year-old finished cheerleading practice late saturday afternoon. sunday, san diego county firefighters respond to calls of dimaggio's house engulfed in flames only to find the body of hannah's mother inside. they also find the remains of hannah's 8-year-old brother ethan which have now been positively identified by the san diego crime lab. monday california goes statewide with an amber alert for dimaggio, hannah, and ethan. for the first time california sends amber alerts to cell phones statewide. tuesday hundreds of tips pour in to authorities. by wednesday potential sightings of dimaggio's blue nissan prompt oregon, washington, and nevada to issue their own amber alerts. on thursday, a chilling comment from police. dimaggio may have booby trapped his nissan and abandoned it and they say the suspect may be carrying explosives.

>> our investigation to date has brought to light a possibility that he has explosives on his person. >> reporter: police say dimaggio may be headed to canada or mexico or just about anywhere really or they say he could be hunkered down in one of the pacific northwest's vast wilderness areas. friday his car was found in idaho. for bret anderson an agonizing wait. >> i can't fathom what happened. he obviously just lost it. >> so how has dimaggio managed to evade capture and how challenging is this man hunt? our guest is a private investigator, former fbi special agent and has been with us several times before and is back to talk about this. we appreciate it. let's talk about this wilderness area. 2.3 million miles. i mean, how do you search something so large? >> what happens is you have to zoom back in where those guys on horse back spotted these folks.

>> okay. >> and you start from there. >> okay. how does that happen? i mean, is there a perimeter that you set? walk us through that. >> what is going to happen, they'll have to -- you can't drive in. so they'll have to set up check points at trail heads. in my mind this is this guy's last stand. he's left san diego. he's made it up here. now what do we do? and i'm telling you, it would be my opinion that if i can't have her no one else can. i think it is a very dangerous situation. >> so you believe that, i mean, it's an uncomfortable thing to discuss, but if they don't come out of here with police getting them you think this is going to be it for both of them? >> i think it could be and let me tell you why. we know he couldn't have brought in that much food. he's got to stay near water. you can look at maybe, you know, this bear grills on tv and see how he can live out in the wilderness for a week with a

shoe string or whatever. these people aren't like that. they have to stay near water. the problem is if you don't treat the water they will have a horrible dysentery problem. >> and this person on horse back said they had light camping gear, just a few things. >> certainly. this weather gets cold at night, down to the 40s. during the day it's 80s. you probably can't afford to put on a fire because if he does, that thing is like a magnet. you can see it for miles. so he's doing some pretty rough camping right now. >> how is it that this man has been able to evade law enforcement across the country looking for him for so long? >> well, interstates. he got on that interstate probably 5 out of san diego, drove all the way up to idaho. decided this was the area he is going to make his last stand, gets in there, if he doesn't steal a car he is on foot.

>> let's talk about the relationship between the two between dimaggio and hannah. we've spoken with some people who know that and say that, quote, he is being villainized and that hannah is not so innocent. also, this rider says that she didn't seem to be under duress. what does that suggest to you if anything? >> my first reaction is, if i've got a 16-year-old, i've captured this 16-year-old, i've threatened her to such extent she is probably not going to say anything. i don't think you can read a lot into that. >> yeah. >> i think you have to read a lot into the fact, though, you've got this guy and a 16-year-old young girl. no. she's not there willingly. >> okay. all right. harold copus, good to have you again. >> thank you. coming up at 8:30 this morning we'll be talking to hannah anderson's best friend who witnessed a disturbing interaction between hannah and dimaggio and also the queen of talk is being talked about again. a lot of buzz about oprah's role in the new film "the butler."

again. good morning everyone. >> it's 7:00 here on the east coast. this is new day saturday. breaking news overnight. we now know that the second body that was found in the california fire was 8-year-old ethan anderson. >> but the mystery of how ethan and his mother died will only be solved when they find this pair. 16-year-old hannah anderson and her alleged kidnapper james dimaggio. finding them will not be easy. they were last seen in the frank church river of no return wilderness area. cnn is in cascade, idaho. the wilderness area is 2.3 million acres. do we know anything about hannah's condition or her state of mind? >> we do. investigators have told me,

victor, that when this horse back rider saw these two individuals, which we have every reason to believe was dimaggio and hannah, that she was -- did she did not seem to be under duress. there seemed to be nothing strange about the interaction between the rider and them or between those two. later, he described it as odd. this was only after he realized these were the two that were probably being looked for in the amber alert. here is how one official put it. >> there was nothing immediately alarming about this pair. the horse back rider said they did appear to have gear with them. they had camping equipment. it seemed to him. i think he described the interaction as odd but nothing alarming. >> the investigator i spoke to as well said the camping equipment they had wasn't the heavy duty sort of camping equipment you might have out here, sort of medium to light gear that you would have in -- for a day or two not a long haul

in deep wilderness where these people were. and it seems that the odd bit that this person was referring to seemed to be that these two people seemed a little out of place for as far back in this wilderness as they were. >> this is a huge wilderness. is it possible that dimaggio could find another way out of the area, perhaps escape to canada? >> it is possible. but look. they went about six miles. from the day that they left the car and covered it with brush and he took the license plates off to where they were spotted on wednesday morning was maybe 24, perhaps 48 hours. it's been now about 72 hours since that spotting. they went six miles in that first bit from the car to where they were first sported. they could go for maybe another six, maybe ten miles today. it is a massive and very, very rough area. it is very difficult for them to make a fast head way in any

really is all about cleanup. removing big trees that were washed up by all of this flood water. just the other day we saw a flash flood situation happen, a big storm cell that came through very quickly but dropped a lot of rainfall. you can see there's plenty of debris around here. you can see the devastation in some of these homes. and as you mentioned now, this latest death just outside of colorado springs. we understand the body of a man was recovered from debris there. that along with the death in south carolina, in oklahoma city, and two deaths here in the state of missouri certainly a difficult and dangerous situation as this storm system continued to push toward the east. we also know that we're still here under the gun. in fact, we are under a flash flood watch. and that's scary news for people who have seen a lot of rainfall fall very quickly over the last several days. >> it is so dangerous. we're seeing that from pictures

coming in. george howell in missouri, thanks. >> let's go from the floods to a raging wildfire now. in southern california, 25 square miles have gone up in flames. riverside county is now under a state of emergency. let's bring in meteorologist jennifer delgado in the cnn severe weather center. is there any relief for this area in sight? >> unfortunately, it doesn't look like they're going to get the precipitation that they would like to get to help put out these fires. right now we do know they're only at 25% containment and current conditions, keeping the winds at 13 miles per hour, not registering any gusts, but for today and tomorrow, we are expecting dry conditions out there and we're also expecting some of those gusts through today and tomorrow to pop up to about 25 miles per hour. now, as we've seen in the video of the fires out there, again shall the silver fire and those started on wednesday, but we're going to continue to follow that as we go through the next couple days because it looks like they've got a ways to go. firefighters have quite a ways to contain this fire.

we do know that reportedly 15,000 people, should say 1500 people were evacuated from their homes since wednesday. so certainly a dangerous situation. we'll continue to follow the fires as well as the ongoing flooding across parts of the midwest and the colorado area. we have new information about embattled san diego mayor bob filner mired in the sexual harassment allegation, a controversy he has left a behavior therapy program we learned a week early according to his chief of staff. >> and recall efforts are ramping up including a letter from personal friend senator barbara boxer urging him to step down. so, into this intensive, in patient therapy and now he is out. >> now he is out but his chief of staff is saying he checked in early which is why he checked out early. that is how they're kouching it. his critics are saying that's not the case at all and that he used this as an excuse to get out of a deposition.

his communications director filed a sexual harassment lawsuit against him. he was going to be deposed august 9th. that didn't happen. he got a letter from his doctor to get out of it. his chief of staff says he is going to continue the therapy in an out patient program. as we mentioned last hour a little twist to the story. the locks have been changed. that according to a local newspaper and affiliate. i just reached out to the mayor's office to try to get comment. >> on his office. >> wow. >> it is unclear if they were informed about the locks being changed before it happened. if they have the new keys. in san diego you don't have to have an interim mayor. he is still the mayor despite having been in this rehab. who knows what is going to happen when he goes back. >> so bizarre. >> and this letter from barbara boxer, he is getting criticism from all angles. this is coming from personal friends now. >> barbara boxer, long-time senator wrote him an open letter which read in part i must say this directly to you. bob, you must resign because you have betrayed the trust of the women you have victimized, the san diegan you represent and the people you've worked with

safeguards on the patriot act program that collects their telephone records. a third proposal, an independent voice to challenge government claims when it asks the judge to approve the program. lastly, the president wants the creation of a website detailing what the intelligence committee does and doesn't do. also that the justice department would make public the legal basis for the programs. but why propose these changes now? well, obama says because the leaks from former nsa contractor edward snowden have given the programs a bad rap. take a listen. >> a general impression has i think taken hold not only among the american public but also around the world that somehow we're out there willy nilly just sucking in information on everybody and doing what we please with it. that's not the case. >> all right. there you go. the president there defending

one. authorities are combing a wilderness area in idaho hunting for hannah anderson and her alleged kidnapper james dimaggio. at the same time, san diego county sheriff has confirmed the family's worst fears saying the second body found in the rubble of a fire was hannah's brother ethan anderson. the body of their mother christina was also found in that fire. look at this. this is number two in manitou springs, colorado. heavy rains have funneled flood water through a canyon here. you see how quickly the cars are just moving through. it is two to three feet of muck there. three people were hurt. reports say one person may be missing. >> and number three, winds are steadily pushing a wild fire near palm springs, california east today so that's led to a state of emergency for river side county. and firefighters will be

battling temperatures near 100 today as they try to knock down the flames there. the wildfire burning more than two dozen homes. >> number four, san diego mayor bob filner has left intensive behavioral therapy a full week earlier than expected but you'll remember filner told reporters he'd spend two weeks in counseling but he was there for just one. cut in half. at least 11 women accused filner of sexual harassment and it is not yet known if he will return to the mayor's office on monday. >> and number five, he's back. embattled yankee slugger a-rod making his return to new york last night. he was greeted with a course of cheers and also boos. 50/50 maybe. is that when you want to be batting .500? >> no. >> his play didn't help silence the nay-sayers. he went 0 for 4 and struck out three times. regardless though the yankees went on to beat the tigers, 4-3. >> not for 27 million a year. you want everybody cheering. >> that's right. >> we've been misled for decades

about medical marijuana. that's cnn's dr. sanjay gupta's stunning conclusion after nearly a year of reporting. his new documentary may make you rethink what you thought about weed. listen. >> people are lighting up all over the country. they call it the green rush. marijuana has moved out of the back alleys and into the open. >> happy day. >> in some states it is legal and could be legalized in a a city near you. so easy to get and many think so harmless. but when the smoke clears, is marijuana bad for you? or could pot actually be good for you? >> well, the answer to that question was not at all what sanjay expected. earlier i asked sanjay, what

changed his mind? >> i've been critical of medical marijuana over the years. i've been reporting on this for a long time and i've been pretty critical of it. written magazine articles and other things. when you look at the medical literature there are some 20,000 papers that'll pop up on medical marijuana. the vast majority, i've written 90% of them, are designed to look at harm, the problems, the perils of marijuana. about 6% are said to look at the bad. that's whey found. that paints a pretty distorted picture. i realize now in retrospect it was a distorted picture. it took me getting out of the country looking at labs and other countries doing remarkable research and talking to a lot of patients. i mean, legitimate patients with legitimate problems. probably too easily i dismissed them as just being malingerers trying to get high. when you come to find out these are legitimate patients for whom marijuana works, and nothing else did, the attitude changes

because it becomes a responsibility to provide adequate care for people. >> you say we were systematically misled. >> i think we have been. up until 1943 marijuana was on the list doctors prescribe medicines. for the last years it has been demonized, thought of differently, made a schedule one drug which puts it in the same category as the most dangerous substances in the country. i think, you know, there were a lot of things going on in the early '30s and '40s that may have led to that but the end answer is we haven't gotten accurate information about this. there is real science here and that needs to be injected into this conversation. >> announcer: lot of the documentary is about medical marijuana but what about recreational use? >> you know, for me, i draw a distinction between these things. i really did focus on medical marijuana. and, you know, recognizing that it's a real medicine that can do things other medicines don't. when it comes to recreational, you know, i think, look.

i have kids. i think about the detrimental impact on young people's brains up until age 25 our brains are still developing. i would talk about that age range. but overall, i think that this is one of those things where it's a medicine and while there is a concern about people abusing this, the trade-off shouldn't be to deny people medical care. i don't want my kids or other people using this, you know, and possibly harming their brains but i don't think that should mean we should withhold it as a medicine. >> so after what you've learned and what a lot of doctors and professionals have learned is there any political appetite to reschedule marijuana? >> it's a great question. it's probably the question. because schedule one means we consider this a drug of high abuse potential and no medical applications. and those things simply aren't true. there wasn't science at that time in 1970 to say it was true and there is science now to probably say that it isn't true. so i think rescheduling is something that really should be on the table but your question is about the appetite for that. there is an appetite among some

year due to a water incident, a jet ski incident. the judge was in usher's favor. usher does still have primary custody. he did state he must inform tameka when he is not watching the kids who is watching the kids and his whereabouts and his schedule. you know, i feel for tameka. to get that phone call again, another one of your sons has an issue when it comes to water. >> yes. >> you would be distraught. >> yes. >> i think we saw some of that come out when she was on the stand. >> she got on the stand and even mentioned how their younger son jumped into the pool who can't even swim to try to save his older brother. that is why she broke down and cried. 85% of the time that usher is not with the children, if that is true, then i understand her wanting custody of her own children. >> she said there are times she doesn't know where the house is. >> exactly. >> who has a phone number or anything. you can imagine what any mother would fear. >> exactly. let's talk now about amanda bynes. so it is no secret she has been struggling with the spotlight. now we know a court has granted her mom legal authority to take

now to ohio where a judge has ruled that the state must recognize the out-of-state marriage of two men even though same-sex marriage is banned there. >> what does this mean for 35 other states with similar bands on same-sex marriages. >> reporter: it was a 7 1/2 minute ceremony on the plane in the tar back in maryland between two people deeply in love who never wanted to get married. >> and then one morning you were watching tv -- >> today the justices ruled that legally married same-sex couples are in fact entitled to benefits. >> i went over to john and hugged him and kissed him and said let's get married. >> reporter: there were two problems. same-sex marriage in ohio where this live in banned and john has

als, and that eventually leads to death, and worried every day could be their last together, and the couple settled on maryland as their destination wedding spot, where they could return immediately to their home in cincinnati. >> getting married is like nothing changed, but yet everything did. >> do you feel the same way? >> absolutely. it's as if -- it's as if a void was filled in our lives. >> reporter: a few day after their wedding in july they met with a civil rights attorney. >> he said, do you realize when he passes away, on the death certificate the state of ohio will list him as unmarried and will not enter his name as your spouse and it broke my heart and

made me mad. >> so bad the couple sued the state of ohio and won, and a judge allowed the couple's marriage to be recognized in a state where gay marriage is banned. no federal or state benefits apply, and that could come later but the decision would mean the two could be buried together in john's family plot. >> i think it's the first chink in the armor. >> reporter: in a state to cnn a spokesman for ohio attorney general said this is a temporary ruling at a preliminary stage under sad circumstances, adding that ohio voters decided in 2004 that gay marriage should not be recognized and are, quote, entitled to the choice they made on this fundamental issue. >> that's ridiculous. >> it just makes me feel that

so excited that what they might tell you is good news, what we have been waiting for. >> reporter: now they face the prospect of hannah, 16 years old, being in the hands of james dimaggio out here in the wilderness alive and well. authorities i spoke to said they did not appear to be armed, and it's not clear whether she is being held under duress today. >> miguel, there are other people in the 2.3 million-acre wilderness area. what is the warning if there is any warning to the other people there? >> reporter: it's a massive area, and there are only a few roads in and out and they are rough roads at that. what authorities have done is created a giant area cordoned, and you can't go very far in 72

hours, as the crow flies, maybe 10 or 12 miles, and they have the huge corden, and they have the roads blocked and they are trying to see if they are trying to get out. >> be sure to stay with us, because in 30 minutes or so we will speak with a friend of hannah's to ask about the relationship between dimaggio and anderson and the so call crush on her. >> we will paint a picture of the person hannah anderson is, and we will talk live with her friend, marissa chavez. and then from floods to a wildfire, almost 30 square miles have gone up i flames, and let's bring in our

meteorologist, jennifer delgado, and is there any sight of relief? you are hoping the humidity goes up and temperatures go down. >> yeah, absolutely. looks like we will not see any significant rainfall anytime soon. temperature right now at 63 degrees, and relative humidity at 69%, and it's rather high and the winds are at 13 miles per hour, but for today and tomorrow we are looking at wind gusts up to 25 miles per hour, and so the threat is certainly not over yet, and you can see tomorrow as well as sunday we are talking high temperatures in the lower 90s. let's go to video and show you what is happening there. we do know that the fire has actually now been at 40% cont n containme containment, and we do know people have been evacuated and they are still working to try and control the situation, but unfortunately we know that roughly 1500 residents have been evacuated and 28 homes have been destroyed, but it looks like they are starting to get better control. yesterday, 25% containment and

now at 40%. >> jennifer, thank you so much for that. we will be checking back in with you. let's talk about the flooding now. 17 states under a flood watch, a warning this morning. >> that's right. rising waters also claimed another life this time near colorado springs. flash floods are being blamed for deaths in oklahoma and missouri, and forecasters say you have even more rain on the way. >> let's bring in george howell who is in hall stastir, missour. >> reporter: when you look at what is left over here, you get to see how forceful this flood water was. you look at the big tree pushed up here, and the water did this, and it pushed homes far on the other side of the property, and it was a storm that came through very quickly and caused great devastation. and then you are seeing it again

today. when you look at the pictures coming out of the state of colorado, just outside of colorado springs on highway 24, just powe rful images coming ou of there and we understand there was another death overnight, a body of a man recovered from debris, and that along with what we saw in south carolina, a death there and a death in oklahoma city and two deaths in the state of missouri, so it has been a dangerous couple of days with people dealing with the rainfall. >> george howell for us in missouri, and thank you very much. we have new information about the embattled san diego mayor, filner. he left an intensive behavior therapy program a week early, and he was there following sexual claims from at least 11 woman. >> what do we know? a lot of people are wondering

why did he leave early? it's a ton of drama. do we know why he left early? >> this thing has been going on for a month, and the first person was his communications director, and his critics say that was his excuse to get out of this was the depositions, and he will continue his pair they, and the new development about the office locks being changed and we reached out to the communication director, and they did not get back, and it's unclear if he has keys to get into his office. >> he is facing mounting pressure to go, and some people are saying let's force him out if he is not going to do it himself. >> he thinks it's not a good

idea to get out of office. signatures need to be collected and they need to be approved and validated, and so bob filner, he could be in the limelight for some months to come, and it could be expensive, and it's around $6 million for the recall. >> yeah, that's a lot. a lot of voters will not be happy to be picking up the tab for that. >> everybody is saying you need to get out of office, and he is the only one saying i need to stick around. >> bob filner says i am staying. >> a strong proponent for himself. a florida man after the custody after the murder of his wife goes viral. the kentucky teen accused of murdering his brother was found not guilty, and he was found not guilty of tampering of evidence, and his father was convicted of

murder and sentenced life to prison. and launching an independent investigation, after a teen was shocked with a taser. authorities say they were forced to chase and corner the aspiring artist before he accused to stop. the teen's father accuses the police are using excessive force. and then the alleged facebook murder confession. 31-year-old derrick medina is being held without bond in a jail, and facing preliminary murder charges. the case gained national atension when the photo he posted of his wife's dead body went viral on facebook. we have to warn you that the images are disturbing. good to have you with us. in this story, you know, these pictures end up on facebook. in a situation like this, what does facebook have to do? >> first of all, victor, this

image is horrific, and it was shared over 100 times on facebook before it was taken down and it took them four to five hours, which obviously people were saying how did it take you four to five hours to take down a picture of a woman's dead body? essentially facebook has in the terms of service that they can take down any violent picture, any picture of a crime. thrp able to take it down. in a statement to cnn, i want to read it to you. they said the content was reported to us and we took action on the profile, removing the content and disabling the profile, and they reached out to law enforcement and we took action and disabled the profile. it had to go viral and it was a horrific image, as you can see. >> facebook reserves the right to take down violent images or anything disturbing, but is there any legal obligation here?

>> this is an interesting one. you would definitely think because of the nature of the images, but i spoke to our legal analyst and listen to what he had to say about this. >> as offensive as it was to post the photograph of somebody who had been murdered, there is nothing illegal about it from the standpoint of facebook. facebook took it down in five or six hours, and in fact, facebook was under no obligation to take the picture down at all, and nor is buzz feed or any entity that runs it. >> and pretty eye opening, and with facebook it's a social media, and we more and more digital evidence online, and i spoke with a source close to the company and it said usually it takes 24 hours to review if people report this kind of thing, and the police are constantly going to facebook and asking facebook to preserve the evidence in the case where there could have been a crime committed.

surveillance programs have not been abused he needs to do a better job explaining them. >> the impression has taken hold around the world that somehow we are out there sucking in information on everybody and doing what we please with it. that's not the case. >> at the same time he says leaks from edward snowden has given the surveillance a bad rap. an independent voice to challenge government claims when it asks a judge to approve the programs, and that the intelligence community create a website detailing what it does and doesn't do, and that the justice department make public the legal basis for the programs, and he wants outside experts to review whether there are new ways, including

tricky. there's a deep divide over this and it's not down party lines. it's surprising where you look at where some of the lawmakers stand on the issue, and for example, peter king, a republican, he agrees with the president when the president says the surveillance programs are valuable in fighting terrorism while on the other hand, you have some of the president's own democrats like the senator from colorado who is not with the president on this, and he says that the president must do a better job balancing national security with privacy rights. so really, brianna, it's going to be tricky to see how he is able to navigate all of this and get the reforms that he is asking for. >> here a couple weeks ago, i think it was two weeks ago, the house voted to raotry and restr the monitoring, and they failed narrowly, and that's how dramatic the whole issue can be. >> yeah, and bipartisan report, and missed it by a few votes. it's going to be tough.

more than two dozen homes. the u.s. consulate in pakistan has been evacuated due to a terror threat. this does not appear to be connected to the earlier threat from al qaeda that shut consulates last week, and only the u.s. embassy in yemen will remain closed. four four vanderbilt football players are facing sexual assault charges. they were kicked off the team after thes in department came to light, and one suspect in custody but nobody knows where the other three are. the sun will soon be rising over the river of no return wilderness area, and the search for hannah anderson could end there. the family wants hannah back and

she is always like crazy and has a good personality and liked by a lot of people. >> how do you know each other? i think you were in gymnastics together, is that right, or you would accompany her? >> yeah, i would go to her gymnastic meets, and we met in middle school, and freshman year we became close and started hanging out all the time. >> so you may have heard this, marissa, hannah and dimaggio were believed to be spotted by a horse back rider and they say she looked fine, and they didn't know until later that maybe something was the matter, and let's listen to what the san diego sheriff says and then i want your response to this. >> i think we should all be optimistic that she appeared to be in somewhat good health and was alive. didn't look like she was being held against her will. >> so he said it doesn't look like she was being held against her will.

you know a little bit about the relationship between dimaggio and this family. what can you tell us? >> i don't think she would have gone willingly with him at all. it's not hard to tell somebody to not act like they are sad or something when they see people, and i don't think she would have gone with him at all. >> you think she is being held against her will despite what you heard from the horse back rider, and we heard from an expert that said that may be the case. and you witnessed a strange interaction betweenimaggio. >> we both felt a little uncomfortable. we were driving home and he just said that he had a crush on her, and we both kind of just, you know, didn't really look at each other and want to make a big deal about it, and then he said, don't think i am weird or

creeper, i just want you to know that if you were my age i would date you. >> how did that make you feel? how did hannah respond? >> she didn't say anything, and she was quiet after that and once we got home, she texted me, well, that was weird. she was creeped out by it if anything, weird. >> that happened a couple months ago? >> yeah, on the way back from her gymnastics meet, so a couple months ago. >> you were coming back from gymnastics with hannah, and i read that she said she wanted you with her if she was going to be alone with him, is that right? >> yeah, whenever he would take her to a meet practice, she wanted me there. >> did her mom know this? >> no, she didn't tell her mom. >> why do you think she didn't tell her mom? >> i think she told me because she said, he was helping out

with ride situations and he was a close friend, and she didn't want to ruin any of that and didn't think anything of it. >> you got the sense that she thought it was weird but maybe something not to be truly alarmed about? >> yeah, i think that's how we both felt. >> can you tell us about the trip to hollywood? >> yeah, it was supposed to be a week trip, and then after a couple days she came back and she asked to hangout, and i said you came back early, and she said that she was on her phone a lot posting pictures and talking to people, and he got upset about that because she was not paying attention to him, and so he took her home early. >> so they won't a trip, just the two of them together to hollywood? >> yeah. >> and did they stay in the same room? what was the situation? >> yeah, i think she said they stayed in a hotel room, and the last night of their trip she went to her godfather's or

something in l.a. >> can you tell us a little more about the relationship? did it kind of seem like he was an uncle? that's what you said that he referred to himself as, so this didn't strike you as really weird that they might go on a trip together, that he might be even a little irritated with her? >> yeah, i mean, he was like an uncle figure to her. he would just, i guess, get jealous over little things, if she was on her phone, and when he would ask her questions she would take a moment to respond, and he got frustrated and he was trying to give her a fun trip, and when she was posting stuff he just got frustrated. >> he got frustrated. did her parents know anything really about this, how close they were or any strange interactions? no? >> no. >> tell us a little bit more about their relationship.

you had known him for years, right? you had been around him many times? >> right, yeah. >> did you ever think that this was weird or you just kind of thought there were a couple strange things that happened? >> he seems like a nice guy. he was just really cool, and after that little comment, you just knew it, but you didn't always think of it or have it on your mind, but didn't seem like anything like that at all. >> maybe something at the time that you sort of brushed aside and didn't focus too much on, but now when you look back to the incidents, what do you think of them? >> now, i think, well, we should have not done -- done something about it or told somebody, but you don't think of those things right away. >> let me ask you this, if hannah were to call you and you are obviously her very good friend and you are very concerned about her, what do you want to say to her? >> if she were to call me i would probably say to just -- i

media mogul, opera winfrey, said she was the victim of racism. the store assistant refused to show her a handbag because it was too expensive. >> i go into a store which shall remain unnamed and i say to the woman, excuse me, may i see that bag right above your head, and she says to me, no, it's too expensive. >> well, we know the name of the store, and how is the owner of the store reacting to the accusation? >> reporter: well, victor, she says the whole thing was a complete misunderstanding. it was a 200% misunderstanding, and possibly down to the fact that the native sales language.

this bag was a $38,000 crocodile bag, and it was high up behind a glass case. and she felt a little embarrassed, the store manager told me that it was so expensive, so when she said to oprah, this is an expensive bag, and she said we have it in other materials, and oprah said i wanted to see it, and the store manager suggested to me that the sales assistant understood that to mean i want to look at it rather than i want to take it down and feel it. that's what the store is saying, and they are saying it was nothing to do with racism, and it was a total understanding and they apologized to oprah that this happened, as half of the swiss tourism board said it was a terrible mistake on the part of the shop, and this is embarrassing for the image of switzerland, victor. >> thank you. thank you so much for starting your morning with us.

>> the next hour of "new day" starts right now. good morning, everybody. i am brianna keilar. >> i am victor blackwell. this is "new day saturday," and we begin this morning with flood watches and warnings in at least parts of 13 states. >> yeah, rising waters claimed another life this time near colorado springs. flash floods are being blamed for deaths in oklahoma, and missouri as well, and forecasters say even more rain is on the way. >> zane asher is in missouri. tell us what is going on there and how people are doing this morning. >> reporter: well, it's all about the cleanup right now. so much devastation, and so much unprecedented rainfall here in such a short space of time and it's really about all rebuilding efforts. just to remind you what the town

of ha of hallstir had to deal with. the creek grew 15 minutes in the space of 15 minutes. walk with me for just one second. all you see here is just soil. believe it or not, there was a mobile home here, and my colleague spoke with the owner of the home, nick ramirez, and he has no idea where his home is. imagine that. and then colorado, for example, highway 24, there is flooding there as well and one person reported dead outside of colorado springs, and oklahoma city, a death reported therend at least two deaths reported in missouri. i wish i had better news in terms of the weather, but we are expecting more torrential downpour at least until tuesday. >> what are folks telling folks?

they realize the threat is very real at this point and hopefully they are being vigilant, but are they getting guidance on authorities on how to stay safe? >> absolutely. the idea is if you get the flash flood on your cell phone, it's important that you go to higher ground immediately. authorities evacuated 50 people from the mobile home park where i am standing and they are in a local church six minutes away, and they will stay there for at least a week, if not several months until they rebuild their lives. >> people need to respect the danger that water poses, and we have pwbeen seeing that from th pictures coming in. >> and george howe reported there was a fear of looting in that area, and there are people that rush in and try to pick apart things left when there is little bits left. >> that's ashame. >> let's go to the floods from

the raging wildfires. almost 30 square miles have gone up in flames, and riverside county under a state of emergency. let's bring in jennifer delgado in the severe weather center. >> weather conditions are not so bad out there right now as we look at the conditions across the region. we are seeing humidity around 69%, and as we go through today as well as tomorrow we have a chance for some of the wind gusts to peak up to 25 miles per hour, but no rain in the forecast. of course we have been following the fire since it broke out on wednesday. let's go to video to show you what firefighters are dealing with. we know the fire containment is up from 25% to 40%, and you can see burning there more than 1,400 firefighters on the scene there, and water trucks and bull dozers, and already 26 home and one business has been destroyed and 1500 people have fled their homes due to the fire. we will continue to follow that

and of course the devastating flooding hitting parts of the midwest, and even into regions like colorado later on. >> jennifer, thank you for that. >> police may be one step closer to catching a suspected killer. authorities warn this man, joe dimaggio, is dangerous. he could be armed with explosives. he is accused of killing a california mother and her 8-year-old son and kidnapping 16-year-old hannah anderson. and authorities turning to a forest in idaho after a sighting there. miguel marquez is there now. >> reporter: the search for hannah anderson and jim dimaggio gets underway today in earnest. there are hundreds pouring into this area. it's a massive area here, the river of no return wilderness area, and their car was found on friday morning, and they had last been seen about 48 hours

before that when a horse back rider saw them, and so it has been sometime since they have been seen by that horse back rider, about 72 hours. they went about six miles from the time that they dropped -- ditched the car to where the horse back rider saw them, and it has been 72 hours since so they could have gone another six or ten miles or so and the investigators creating a corden, and they are trying to focus in on their search and catch this guy. back to you. >> can you talk a little bit about exactly how far maximum do you think authorities think these two may have been able to make it? the horse back rider spotted the pair, and you are assuming they are on foot? >> reporter: they can't get very far. in a day or two they got six

miles, and in 72 hours they could probably get eight, maybe ten miles, but there are -- it's 300 miles of wilderness out there, but if they have fresh water, they can find shelter, and they had light camping gear, and it gets cold in the 40s here, and you could get high though therma, and all of those things authorities will be looking for. they will be looking for places that they might be going to, trying to guess, basically, where they are, because they cannot cover the entire area. >> miguel marquez, thank you very much. >> last hour we spoke with marissa chavez, who is a good friend of hannah, and she described a close relationship with dimaggio. >> we were driving home and he just said that he had a crush on her, and we both just kind of really didn't look at each or want to make a big deal of it.

i he said i wanted you to know if you were my age i would date you. if she was on her phone, she said when he would ask her questions, she would take a second to respond or something, and he just got frustrated. >> that was from the interview last hour with the friend of hannah anderson. another big story happening this week, listen to this. >> this is very difficult. >> ridiculous. this is ridiculous! >> step down. >> thank you. >> a mother in pain. foster raymond, raw emotion, and hugs at the end of a custody battle between usher and his ex-wife, where a judge ruled the music mogul could keep custody of his two boys after one of them drowned this week. >> and this was a hearing full of drama, and it ended up two

hours long. and she became emotional after they played the 911 call from the drowning incident, and you could tell it was very difficult for her to relive that moment, and then there was usher, who was calm and in control, and he answered questions about the pool incident and explained what happened that day. in the end the judge ruled in his favor, and after the decision was issued, usher seemed very relieved. he hugged his attorneys, and then he walked over to his ex-wife and hugged her. here is what they each had to say about the hearing. take a listen. >> what do you think about the judge's ruling? give us one minute. fplt i need to get back to the hospital. >> it was only a very small amount of evidence that was allowed because it was an emergency trying to get something changed immediately, but for a long-term, i will see

him on the 27th. >> foster raymond making it clear that she will continue to seek physical custody of the children, and the 5-year-old that nearly drown this week is doing well, and usher testified the boy could be out of the hospital as early as this weekend. >> did you see them hug? it seemed like they had an exchange, didn't it? >> yeah, they did say something to each other, and we asked them about it and they did not say what usher told her and her response. >> yeah, that was probably surprising for those in the courtroom, and the divorce was contentious, and his camp didn't expect it, and then at the end, a hug and a few words, and she got a phone number to get in contact with him in case there is something that comes out. >> that was her complaints, where she said i never know where the kids are, and she is also coming off the fact that her son -- usher's step son died

now to ohio where a judge has ruled that the state must recognize the out of state marriage of two men even though same-sex marriage is banned in ohio. what does this mean for the 35 other states with similar bans on same-sex marriages? >> reporter: it was a 7.5-minute ceremony on the plane on the tarmac in baltimore, maryland, between two people that were in

love and never really wanted to get married. and then one morning you were watching tv -- >> the justices ruled legally married same-sex couples are entitled to federal benefits. >> when the rulings came out, i went over to jon and hugged him and kissed him and said let's get married. >> reporter: there were two problems, same-sex marriage in ohio where they live is banned and john has als, and that eventually leads to death. worried that every day could be their last together, the couple settled on maryland as their destination wedding spot. they could travel by medical jet, and say their vows at the airport and return immediately to their home in cincinnati. >> getting married, it's like nothing changed, but yet everything did. >> do you feel the same way? >> absolutely. it's -- it's as if a void was
